Legal Separation

Legal separation often refers to the time period when a couple is separated and no longer living together
but has not filed for or obtained a divorce. Unlike divorce, legal separation does not put an actual end to
the marriage, but rather enables or allows you to live separately but remain married until a divorce is filed.

 

During the time you are legally separated and before the final judgment of your divorce, you can
obtain an order from the Court outlining the relative and temporary rights and responsibilities of each
spouse as well as determine certain rights regarding your children.

Key Differences Between Legal Separation and Divorce

  • Legal separation allows for the retention of medical benefits and certain other benefits that
    divorce would bring to an end.

  • You are able to live separately and retain your marital status for religious beliefs and purposes.

  • You may remain technically and legally married for 10 years so that you can take advantage of
    benefits set up by the Uniformed Services Former Spouse Protection Act as well as some social
    security benefits.

  • If you make the decision to go through with the divorce, an official legal separation agreement
    that was entered into between the parties can be converted into a divorce settlement agreement.
