Pre- and Postnuptial Agreements

At Young & Maslowski, LLP, we will assist you in creating a nuptial agreement that fits your purpose,
whether it is before or after your union.

While a nuptial agreement may seem unromantic, it’s just smart financial planning. It ensures your financial matters are handled according to your wishes rather than the state’s decision. By hiring an experienced divorce attorney to assist you with your nuptial agreement, it helps make the agreement fair to both parties, and it also helps to ensure that the document will be valid and enforceable in court should it be necessary
to invoke.

At Young & Maslowski, LLP, we have substantial experience in drafting nuptial agreements for our clients
that are both legally enforceable and satisfy our client’s intentions and objectives.

Differences Between Pre- and Postnuptial Agreements

  • Pre- and postnuptial agreements serve the same purpose. A Prenuptial agreement is a private
contract and agreement entered into between two parties before their marriage takes place. It
specifies the property, financial, and other rights of the parties if they were ever to divorce. A postnuptial agreement is an agreement specifying the same terms that are entered into after the
couple is married, but before the time of divorce.

  • The biggest difference between a prenuptial agreement and a postnuptial agreement is the time at which the agreement is reached. A prenuptial agreement takes place before a couple is wed, while
a postnuptial agreement is settled after marriage.

The Most Common Reasons to Seek a Postnuptial Agreement

  • Did not complete before marriage
  • Change in income of one party
  • Large gift or inheritance
  • New business

Your postnuptial agreement should be reviewed periodically, especially if your lifestyle changes or
your salary has significantly increased.
